2. Scope of application, definitions


2.1 The following General Terms and Conditions (GTC) apply to all contracts that a consumer or entrepreneur concludes with us via the product offers presented in the online shop.

2.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.


3. Contract language and conclusion of contract


3.1 Contracts in our online shop are concluded exclusively in German.

3.2 Our product offers in the online shop are non-binding. By clicking on the ‘Buy now’ button at the end of the ordering process, you are submitting a binding contractual declaration to conclude a purchase contract for the products in your shopping basket. You are bound to your contractual offer for a maximum of three days.

3.3 A contract is concluded when we accept your contractual offer within the binding period by sending an order confirmation.


4. Prices, shipping costs


4.1 All prices quoted in the online shop are total prices. The total prices include all price components, including the applicable statutory value added tax.

4.2 We charge the costs for packaging and shipping (shipping costs) separately if the products are not marked as free of shipping costs. The amount of the shipping costs is shown separately for each product on the product detail pages.


5. Terms of payment


We offer the following payment options:


Payment via PayPal


If you select a payment method offered via PayPal, payment will be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, or a payment service provider commissioned by PayPal in accordance with the current PayPal Terms of Use. PayPal accepts the following credit cards: Visa, Mastercard, American Express, Discover, UnionPay. This payment method does not incur any additional costs for you, except for any exchange rate fees if the payment is made in a currency other than EUR or if your credit card company charges additional fees.
If you select the payment method ‘PayPal instalment payment’, we will assign our payment claim to PayPal. Before accepting the assignment declaration, PayPal will carry out a credit check using the customer data provided. We reserve the right to refuse you the payment method ‘PayPal instalment payment’ in the event of a negative credit check result. If the payment method ‘PayPal instalment payment’ is accepted by PayPal, you can pay the invoice amount to PayPal under the conditions specified, which will be communicated to you during the ordering process. In this case, you can only make payments to PayPal with debt-discharging effect. However, even in the event of assignment of claims, we remain responsible for general customer enquiries, e.g. regarding goods, delivery times, shipping, returns, complaints, revocation declarations or credit notes.

Payment by credit card (VISA/MasterCard)


If you select credit card as your payment method, payment will be processed by the payment service provider Adyen N.V. German Branch, Jägerstraße 27, 10117 Berlin.


Payment by Zinia invoice purchase


When purchasing on account from Zinia, the order must be paid for within 30 (thirty) days of dispatch. The payment method requires, among other things, a successful credit check by Zinia by Open Bank S.A. (hereinafter referred to as ‘Zinia’). Zinia will inform you of the due date by email and/or SMS and provide payment instructions.

If payment has not been received by Zinia after the aforementioned 30 (thirty) days, various payment reminders will be sent by email and SMS. Zinia will charge a fee for each payment reminder sent (with a maximum of three chargeable reminders being sent).
If the amount due has still not been paid after these payment reminders, the invoice will be handed over to a specialist debt collection agency, which will then charge its own fees.

Payment via Google Pay


In Google Pay, you can save your PayPal account, debit or credit card to make quick and easy payments. When paying, click on the Google Pay button. Select a payment method when prompted and enter your shipping address. Then confirm your order and authorise your payment instruction.


Payment via Apple Pay


Paying with Apple Pay is quick and easy. Once you have entered your account information in the Wallet app, simply select Apple Pay as your payment method during the ordering process. You can connect Apple Pay to both a credit card and a debit card. Then confirm the payment via Face ID or Touch ID or a macOS-powered device.


Delivery restrictions and delivery date


6.1 We deliver exclusively within Germany.

6.2 The delivery date for the goods is based on the information provided on the product detail pages. When paying in advance, you issue a payment order to your payment service provider (e.g. credit institution). The delivery period begins on the day following the payment order to your payment service provider. If the end of the delivery period falls on a Saturday, Sunday or a nationally recognised public holiday at the place of delivery, the next business day shall be deemed the end of the delivery period.


7. Retention of title


The goods remain our property until full payment has been received.


8. Statutory right of withdrawal


The statutory right of withdrawal applies exclusively to consumers within the EU Member States. The definition of a consumer is set out in Section 2.2 of these General Terms and Conditions.


9. Statutory liability for defects

You are entitled to the statutory warranty claims for products purchased from us.


10. Applicable law, place of jurisdiction


10.1 The law of the Federal Republic of Germany applies to the conclusion and execution of all contracts, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has his habitual residence is not restricted.

10.2 In business transactions with merchants and legal entities under public law, our place of business shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same shall apply if an entrepreneur does not have a general place of jurisdiction in Germany or if their place of residence and/or habitual abode is unknown at the time the action is brought. Our right to appeal to the court at another legal place of jurisdiction remains unaffected by this.


B. CUSTOMER INFORMATIONEN


1. Individual technical steps leading to the conclusion of the contract


The ordering process in our online shop is carried out using labelled and self-explanatory buttons, which are activated with a click of the mouse. To submit a binding contractual declaration, you must complete the following technical steps:


  • Adding the item to the shopping basket
  • Log in to the online shop with your existing customer account (username/password), register as a new customer or place an order as a guest and enter your personal details.
  • Selecting the payment method
  • Summary of all order details
  • Submission of your contractual declaration containing your contractual offer.

The acceptance of your contractual declaration is governed by Section 3 of our General Terms and Conditions (see above under A.).


2. Storage and retrieval of the contract text after conclusion of the contract


The contract text is stored by us. You can access the contract text (e.g. product descriptions, terms and conditions, and customer information) during the ordering process and print it out and archive it using the print function of your internet browser. Immediately after placing your order, we will send you an order confirmation with the details of your order and the contractual terms and conditions, which you can print out and save. Once the contract has been concluded, the contract text will no longer be available to you in our online shop. If you have registered a customer account, your orders will be archived under ‘My account / My orders’.


3. Detection and correction of input errors in the ordering process


You can identify input errors at any time during the ordering process because your entries are saved immediately and displayed on the screen. If you make any input errors, please use the labelled and self-explanatory buttons that we provide during the ordering process to correct them. On the final order page, you can check and correct all order details before submitting your contractual declaration.


4. Statutory cancellation policy

Right of withdrawal


You have the right to withdraw from purchase contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.


Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. We shall bear the costs of returning the goods if you use the return label provided by us free of charge to frank the return shipment. Otherwise, you shall bear the direct costs of returning the goods. You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality.
